These Terms of Service ("Terms") govern your use of the PlacePoint mobile app, website, and related services (together, the "Services") provided by PlacePoint SIA ("PlacePoint", "we", "us", "our"), a private limited company registered in Latvia. By creating an account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who can use PlacePoint

You may use the Services only if:

You are at least 18 years old.
You can form a binding contract under the laws of the country you live in.
You are not barred from using the Services under any applicable law, and you have not previously been banned from the Services.

If you use the Services on behalf of a company, agency, or other organization, you represent that you are authorized to bind that organization, and "you" in these Terms means both you personally and the organization.

2. Your account

You need an account to list property, send messages, book viewings, or save searches. You can browse listings without an account.

When you create an account

You agree to:

Provide accurate information (real name or business name, working email, working phone if you choose to verify).
Keep your password secret and not share your account.
Be responsible for everything that happens through your account unless and until you tell us it has been compromised.
Tell us immediately at support@placepoint.lv if you suspect your account has been accessed without your permission.

We may require email verification, phone verification, or business verification (for agencies) before certain features become available. You can delete your account at any time in Settings → Delete Account. The retention rules in our Privacy Policy describe what happens to your data afterwards.

3. What PlacePoint costs

The core Services are free:

Browsing listings is free.
Creating an account is free.
Listing a property is free, with no per-listing charge and no monthly fee.
Messaging other users is free.
Booking a viewing is free.

The only paid feature: listing boosts

The only thing we charge for is listing boosts: a one-time purchase that places your listing at the top of search results for either 7 or 30 days. Boosts are sold through Apple In-App Purchase (iOS), Google Play Billing (Android), or Stripe (web). We do not take a commission on rentals, sales, or any transaction between users. We are not a party to those transactions. We may introduce additional paid features in the future. If we do, they will be optional, clearly disclosed, and not retroactively applied to existing free features.

3.1 Refunds

Boost purchases are refundable only as required by law or by the applicable platform’s policy:

Apple App Store purchases — refunds are handled by Apple through reportaproblem.apple.com. We do not have authority to issue Apple refunds directly.
Google Play purchases — refunds within the Google Play return window are issued automatically by Google; outside that window, contact us.
Stripe (web) purchases — contact support@placepoint.lv within 14 days of purchase for a refund of any unused boost duration, in line with the EU Consumer Rights Directive (2011/83/EU) for digital services.

If a boost purchase fails for technical reasons (e.g., the listing was removed by us before the boost activated), we will issue a full refund regardless of platform.

4. Listings — what is allowed and what is not

4.1 Required of any listing

A listing must:

Describe a real property that you have the right to list (you own it, you manage it, or the owner has authorized you to list it).
Show the actual property in its photos. Stock photos, generic renders, or photos of a different unit are not permitted.
State an honest price, area, and number of rooms.
Be placed at the correct location on the map.
Be in Latvian, English, or Russian.

4.2 Prohibited listings

You may not list:

Property you do not have the right to list.
The same property under multiple accounts to game search ranking.
Property whose listing would violate applicable law (e.g., short-term-rental restrictions in your municipality).
"Bait" listings advertising prices or properties that aren’t actually available, in order to redirect users to other listings.
Listings whose primary intent is to advertise an unrelated service (lending, mortgage brokerage, moving services, etc.).

4.3 Moderation

Every new listing is reviewed by our moderation team before going public, usually within an hour during Latvian business hours and within 24 hours otherwise. We may approve, reject, or request edits. We may remove or hide a listing at any time if it violates these Terms or applicable law. Where practical we will tell you why and give you a chance to fix it.

4.4 You own your listing content

You keep all rights to the photos, text, and other content you post. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, copy, transmit, and adapt that content only to operate and promote the Services (including showing your listing in search results, marketing screenshots of the app, and social-media posts featuring listings on the platform). This license ends when you delete the content, except for cached or backed-up copies retained for the periods listed in our Privacy Policy.

5. Messaging and viewings

You can use built-in messaging to contact other users about listings. By sending a message you agree:

Not to spam other users.
Not to send threats, harassment, or unlawful content.
Not to use the chat for off-topic commercial pitches (recruiting, unrelated sales, etc.).
That message contents are stored on our servers as described in the Privacy Policy.

Booking a viewing through the slot picker creates a non-binding appointment between you and the other party. PlacePoint does not guarantee that a viewing will actually take place; that is between you and the other user.

6. User conduct

You agree not to:

Use the Services for anything illegal under Latvian or EU law.
Impersonate another person or organization.
Scrape, copy, or systematically extract listings or user data except as expressly allowed in writing by us.
Reverse-engineer the Services, attempt to bypass authentication, abuse rate limits, or intentionally probe security vulnerabilities in production. Good-faith security research is welcome — email security@placepoint.lv before testing.
Attempt to recover other users’ contact information except through the in-app messaging the other user has consented to.
Upload malware, run automated traffic against our APIs without permission, or interfere with the Services for other users.

We use reasonable rate limits, automated abuse detection, and manual moderation to enforce these rules. Repeated or serious violations result in account suspension or permanent ban; severe violations are reported to law enforcement.

7. Reporting and takedowns

You can report a listing, message, or user from inside the app ("Report" button) or by emailing support@placepoint.lv. We review all reports.

If you are a rights-holder and believe a listing infringes your copyright, trademark, or other IP, email us with the details — which listing, what right, and proof you hold the right. We operate a notice-and-takedown process consistent with the EU Digital Services Act.

8. Boosts: how they work

When you buy a boost, your listing appears in a sponsored slot at the top of relevant search results for the chosen duration (7 or 30 days), starting from when you activate the boost in-app.

Boosts:

Do not change the listing’s content, only its position.
Do not exempt you from these Terms — boosted listings are still subject to moderation, and a boost may end early if the listing is removed for a Terms violation.
Are clearly labelled as "Boosted" or "Sponsored" in the UI.

If we remove a boosted listing because of a Terms violation, the unused portion of the boost is forfeited.

9. PlacePoint is a marketplace, not a party to transactions

PlacePoint provides a platform for property owners, agencies, and prospective buyers/renters to connect. We are not a party to any rental or sale agreement, viewing, deposit, or payment that arises between users. Specifically:

We do not verify the legal status of every property.
We do not hold deposits, escrow funds, or process rent payments between users.
We do not guarantee the accuracy of any listing.
We do not represent buyers, sellers, landlords, or tenants.
Verified-landlord and verified-agency badges indicate that a user has completed our verification flow; they do not guarantee the user’s conduct or the legal status of any listing.

You are responsible for your own due diligence: visit the property, read the contract, check the title, and use a notary or licensed realtor where appropriate.

10. Verification badges

Verified-landlord and verified-agency status are granted after we review documents (passport or eID for individual landlords; company registration documents and a licensed-agent certificate for agencies). We may revoke verification at any time if we determine the underlying basis is no longer accurate.

A verification badge is not a recommendation or endorsement.

11. Suspension and termination

We may suspend or terminate your account if:

You materially breach these Terms.
We are required to do so by law or court order.
We have a reasonable belief that your account has been compromised, used to defraud other users, or used to violate applicable law.

Where the breach is non-severe and remediable, we will usually warn you and give you a chance to fix it before suspension. You may terminate your account at any time, for any reason, in Settings. On termination by either side, the license you granted us in Section 4.4 ends except for cached copies and copies retained as described in our Privacy Policy.

12. Disclaimers and limitation of liability

The Services are provided "as is" and "as available". Without limiting your statutory rights as a consumer under Latvian and EU consumer-protection law, we do not warrant that:

The Services will be uninterrupted, timely, secure, or error-free.
Every listing is accurate, lawful, or available.
Other users will behave honestly or perform any agreement they reach with you.

Liability cap

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or relating to the Services is capped at EUR 100 or the total amount you have paid us for boosts in the 12 months preceding the claim, whichever is higher.

What we never exclude

We do not exclude or limit liability for:

Death or personal injury caused by our negligence.
Fraud or fraudulent misrepresentation by us.
Anything else that cannot lawfully be excluded under Latvian consumer-protection law (Patērētāju tiesību aizsardzības likums) or EU consumer-rights regulations.

If you are a consumer in the EU, nothing in these Terms reduces your statutory rights.

13. Changes to the Services and to these Terms

We may modify, suspend, or discontinue features at any time. For material changes that affect your use of the Services we will give reasonable notice in-app or by email.

We may update these Terms over time. For material changes we will:

Update the "Last updated" date above.
Notify you at least 30 days in advance in-app or by email.
Where the change is unfavorable to you, give you the option to delete your account before the change takes effect.

Continued use of the Services after a change takes effect means you accept the updated Terms. If you do not accept, your only remedy is to stop using the Services and delete your account.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia, without regard to conflict-of-laws principles. The courts of Riga, Latvia have exclusive jurisdiction, except that:

If you are a consumer resident in another EU member state, you retain the right to bring proceedings in the courts of your country of residence and to invoke the mandatory consumer-protection rules of that country.
You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

We encourage you to contact support@placepoint.lv before escalating a dispute. Most issues are resolved informally within a few working days.

15. General

Severability — If any provision of these Terms is found unenforceable, the rest remains in full force.
No waiver — Our failure to enforce a provision is not a waiver of our right to enforce it later.
Assignment — You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all our assets, on the same terms.
Entire agreement — These Terms, together with our Privacy Policy and any feature-specific terms we present in-app, constitute the entire agreement between you and us regarding the Services.
Languages — These Terms are published in English, Latvian and Russian. If there is a conflict between the versions, the Latvian version prevails for users resident in Latvia and the English version prevails for all other users; the Russian version is provided for convenience.
